1. Acceptance of these terms

These Terms of Use form an agreement between you and Pathwalker Publishing Ltd. By accessing the website, creating an account, placing an order, downloading content, submitting a manuscript or requesting a service, you confirm that you have read and agree to these terms.

Where a written publishing agreement, quotation, order confirmation or service schedule conflicts with these general terms, the more specific written document will govern that particular transaction.

2. Eligibility and accounts

• You must provide accurate information when creating or maintaining an account.
• You are responsible for protecting your password and for activity conducted through your account.
• You must promptly tell us if you suspect unauthorised account access.
• You may not impersonate another person, create misleading profiles or use another person’s account without authority.
• Users acting for an organisation confirm that they have authority to bind that organisation where applicable.

3. Acceptable use

You must not:

• Use the website for unlawful, fraudulent, abusive or deceptive purposes.
• Attempt to gain unauthorised access to accounts, servers, databases or administrative areas.
• Upload malware, malicious code or content intended to disrupt the website.
• Scrape, copy or extract substantial website content without written permission.
• Interfere with payment, security, download-control or account-verification mechanisms.
• Submit content that infringes copyright, privacy, confidentiality, trademark or other rights.
• Use our name, logo, book covers or branding in a way that falsely suggests endorsement or partnership.

4. Book purchases and orders

Product descriptions, formats, prices, availability and delivery estimates are provided in good faith but may change. An order is not finally accepted until payment is confirmed and the order is processed.

• You are responsible for providing a correct delivery address and contact information.
• Delivery timeframes are estimates and may be affected by couriers, location, inventory or circumstances beyond our control.
• Colour, dimensions and appearance may vary slightly from digital images because of printing and display differences.
• We may cancel or limit an order affected by pricing error, suspected fraud, stock shortage or technical error.

5. Digital books and downloads

Digital content is licensed for the personal use of the purchaser or authorised account holder. Unless expressly permitted in writing, you may not reproduce, upload, share, resell, distribute, modify, remove rights notices from or create unauthorised derivative works from digital content.

Download links, access tokens and account credentials must not be shared. We may restrict or revoke access where we reasonably believe digital content is being distributed unlawfully or contrary to these terms.

6. Publishing and author services

Manuscript assessment, editing, proofreading, design, typesetting, ISBN support, production, distribution, marketing and related services are governed by the quotation, project scope, payment schedule and written agreement issued for the engagement.

• Timelines depend on the author’s cooperation, manuscript readiness and timely approvals.
• Changes outside the agreed scope may require additional fees and revised deadlines.
• Printing, distribution, marketplace listing and sales outcomes may depend on independent third parties.
• No sales, bestseller, media, ranking or income result is guaranteed unless expressly stated in a signed agreement.
• The author remains responsible for factual accuracy, permissions, defamation risk and lawful ownership of submitted material.

7. Manuscript submissions

Submitting a manuscript does not obligate Pathwalker Publishing Ltd to publish, represent, review or accept the work. We may decline a submission at our discretion.

By submitting material, you confirm that:

• You own the material or have authority to submit it.
• The material does not knowingly infringe another person’s rights.
• The submission does not contain unlawful, malicious or unauthorised confidential material.
• You understand that preliminary review does not amount to acceptance for publication.

8. Intellectual property

The website design, logos, brand assets, text, graphics, photographs, book-cover images, videos, software and other website materials are protected by applicable intellectual-property laws.

Copyright in an author’s manuscript remains subject to the author’s publishing agreement. Rights granted to Pathwalker Publishing Ltd will be defined in the relevant contract.

9. Payments, cancellations and refunds

Prices are stated in the currency displayed at checkout or in the applicable quotation. You are responsible for taxes, bank charges or transaction costs that apply to your payment.

Physical books

Requests concerning damaged, defective or incorrectly supplied physical books should be reported promptly, with supporting photographs where appropriate. Eligibility for replacement or refund will depend on the circumstances, applicable law and the published return policy.

Digital content

Because digital products can be accessed immediately, digital purchases are generally not refundable after download or access, except where the file is materially defective, the wrong item was supplied or a refund is required by applicable law.

Publishing services

Deposits, stage payments, cancellations and refunds for publishing services are governed by the relevant quotation, invoice and signed service agreement. Work already completed and committed third-party costs may be non-refundable.

10. Third-party services and links

The website may connect to payment processors, delivery providers, marketplaces, social networks, analytics tools and other independent services. We are not responsible for third-party availability, content, security, policies or performance.

11. Disclaimers

The website and general informational content are provided on an “as available” basis. We aim for accuracy but do not warrant that every page, price, description, link or feature will always be complete, current or error-free.

Books, articles and educational materials may express the views of their respective authors. They do not automatically constitute legal, medical, financial or other regulated professional advice.

12. Limitation of liability

To the maximum extent permitted by applicable law, Pathwalker Publishing Ltd will not be liable for indirect, incidental, consequential, special or punitive loss arising from use of the website, unauthorised account activity, third-party services or reliance on general informational content.

Nothing in these terms excludes liability that cannot lawfully be excluded or limited.

13. Suspension and termination

We may suspend or terminate access, disable a profile, restrict downloads or refuse service where reasonably necessary to address fraud, security risk, unlawful conduct, non-payment, infringement or material breach of these terms.

14. Governing law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria. The parties should first attempt to resolve a dispute through good-faith communication. Where resolution is not achieved, the dispute may be submitted to a court or other lawful dispute-resolution process with jurisdiction in Nigeria, subject to any specific written agreement between the parties.
